Criminal law 2024: Three new laws – Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita, and Bharatiya Sakshya Adhiniyam – were implemented on Monday. It is replacing old colonial-era laws like the Indian Penal Code, Code of Criminal Procedure, and Indian Evidence Act.
Criminal law 2024 A street vendor in Delhi’s Kamla Market Police Station was involved in the first FIR under the new laws on Monday. The charges were related to blocking a footover bridge at New Delhi Railway Station, as per Section 285 of Bharatiya Nyay Sanhita. Informative posters about the new laws were displayed in various locations. It is especially at police stations in the capital city. Some of these posters were spotted at police stations in Connaught Place, Tughlak Road, Tughlaqabad, and other areas. The purpose of these posters was to inform the public about the new laws and the changes they will bring. New criminal law 2024: Main highlights The new laws in India will bring significant changes to the criminal justice system. It is replacing old colonial laws with the Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita, and the Bharatiya Sakshya Adhiniyam. Bharatiya Nyaya Sanhita has 358 sections, with 20 new crimes added and increased sentences for 33 crimes. Fines have been raised for 83 crimes, and mandatory minimum punishments are now in place for 23 crimes. Community service penalties are now applicable to six crimes, and 19 sections have been repealed or removed from the Act. A new chapter focusing on ‘Crimes against Women and Children’ has been introduced. It will address sexual offenses. It included changes to provisions regarding rape of minors under 18 years old. The Bharatiya Nyaya Sanhita outlines strict punishments for gang rape. It includes up to 20 years imprisonment or life imprisonment. It also addresses fraudulent sexual intercourse and false promises of marriage. Additionally, the Sanhita defines terrorism for the first time and imposes severe penalties, such as the death penalty or life imprisonment without parole. Acts of terrorism, including property destruction, are covered under this law. Victims are entitled to zero FIR filing, free copies of FIRs, and updates on the investigation progress. New criminal law 2024: Bharatiya Nagrik Suraksha sanhita The Bharatiya Nagrik Suraksha Sanhita has 531 sections, while the CrPC has 484 sections. A total of 177 provisions have been modified in the Sanhita, with nine new sections and 39 new sub-sections added. The Act includes 44 new provisions and clarifications. Timelines have been included in 35 sections, and audio-video provisions have been added in 35 places. A total of 14 sections have been repealed and removed from the Sanhita. New criminal law 2024: Bharatiya Sakshya Adhiniyam The Bharatiya Sakshya Adhiniyam will have 170 provisions. It is compared to the original 167 provisions, with a total of 24 provisions being changed. Two new provisions and six sub-provisions have been added, while six provisions have been repealed or deleted in the Adhiniyam.The recent criminal justice reform in India has shifted priorities towards crimes against women, children, and the nation.
